Mediation Perspectives: Reframing the Charities and Terrorism Debate

The UK’s Daily Telegraph ruffled a few feathers earlier this month by building a story around a few out-of-context remarks by the head of the UK’s Charity Commission to suggest that millions of pounds raised to assist victims of the conflict in Syria were being diverted to terrorist groups. The Charity Commission reacted swiftly to correct the story, pointing out that they possessed no evidence of any such diversions and that they work very closely with charities to minimize the risk that any could occur.

Fears of charitable donations being diverted away from their intended recipients are nothing new. Nor are accompanying fears that diverted money is ending up in the hands of people with less-than-good intentions. What is relatively new is how these fears are being addressed since the launching of the “global war on terror” in the wake of the 11 September 2001 attacks in the US.

Humanitarian organizations have long recognized that they have a responsibility towards both their donors and their beneficiaries to ensure that aid reaches the people it was intended for. Many organizations have developed their own systems of checks and balances to ensure that it does. However, it has long been recognized, both by donors and charities, that in conflict and emergency situations no system is perfect and there is always a risk that some aid is diverted or ends up in the wrong hands. What has changed with the dominance of a counter-terrorism discourse is that this risk of diversion has been defined as a security threat due to the fear that those wrong hands are terrorist hands.

New Collaborations for Better Maps in Crisis

Accurate and timely maps are a vital resource in contemporary disaster and crisis management. Maps are essential for identifying vulnerabilities, monitoring the effects of disasters and organizing countermeasures. Traditionally, the mapping of crises was the exclusive domain of experts, including cartographers and crisis management professionals. But with the growing democratization of information and communications technology, this monopoly is disappearing.

Recent disasters have witnessed a new generation of online maps, created by civil society actors and relying on volunteers to collect, organize, verify, visualize and share geo-refer­enced information. Prominent examples include the crowdsourced maps created in the aftermath of the Haitian earthquake in 2010 and during Hurricane Sandy in 2012. Although these mapping projects differed in many respects, they had a common aim – to aggregate geo-referenced information from a large number of sources in order to make that information useful for emergency man­agers as well as those affected by the crisis.

The Price of Peace

MADRID – The relationship between peace and justice has long been the subject of polarizing debates. Some argue that the pursuit of justice impedes conflict-resolution efforts, while others – including International Criminal Court (ICC) Chief Prosecutor Fatou Bensouda – contend that justice is a prerequisite for peace. As President Juan Manuel Santos leads Colombia through the most promising peace talks in five decades of brutal conflict with the Revolutionary Armed Forces of Colombia (FARC), he will have to consider this question carefully.

The Nuremberg trials, which followed Nazi Germany’s unconditional surrender in World War II, provide an ideal model for post-conflict justice. But, in conflicts in which no side has been defeated, the peacemaker’s job becomes more challenging. Given what is at stake, a trade-off between reconciliation and accountability may well be inescapable.

Since 1945, more than 500 cases of amnesty in post-conflict transitions have been recorded; since the 1970’s, at least 14 states – including Spain, Mozambique, and Brazil – have given amnesty to regimes guilty of serious human-rights violations. In South Africa, amnesty was a key feature of the “truth and reconciliation” process that facilitated the peaceful transition from more than four decades of white-minority rule to democracy.

Similarly, in 2003, Nigeria’s president offered asylum to his Liberian counterpart, Charles Taylor, on the condition that Taylor retire from politics, thereby helping to end the rebellion against him. (In this case, justice was later served; in 2012, the Special Court for Sierra Leone convicted Taylor of 11 counts of aiding and abetting war crimes in Sierra Leone, making him the first former head of state to be convicted for such crimes by an international tribunal since Nuremberg.)

Although it may be painful to offer a safe exit to war criminals and human-rights abusers, the prospect of ending the suffering of civilians can take priority over a principled stand for justice. Who today would oppose amnesty for Syrian President Bashar al-Assad if it ended the brutal civil war that has led to more than 100,000 deaths and created nearly two million refugees (including more than a million children) in just two years?

Intervention in Mali: Does R2P Apply?

Six months ago, a coup d’état toppled President Amadou Toumani Toure (“ATT”), the democratically elected leader of Mali, and soon thereafter ATT went into exile; armed groups in the north, inspired by a strict and austere interpretation of Islam and the desire to impose Sharia law on the entire country, have engaged in jihadism, terrorism and arms trafficking; and many of Mali’s cultural treasures and riches have been destroyed by the same armed groups who consider much of modern civilization – i.e., the West – to be decadent and depraved and thus in need of purification.

Lamentably, most of these developments – marauding and irredentist Islamists linked to al-Qaeda in the Islamic Maghreb, the destruction of cultural relics and objet d’art, threats to World Heritage sites – have been overlooked or ignored. To be sure, some outlets – notably The New York Times and the BBC – have done their part to sound the alarm, and Alain Juppé, the former foreign minister of France, was told in March that if these groups gained control of the north, Mali would be turned into another Afghanistan.

Swiss Humanitarian Aid: Sharing Responsibility

Drought forces thousands of people to cross the border from Somalia to Kenya every day. Violence erupts in a refugee camp in Ethiopia due to insufficient shelter. Rebel groups evict people from their homes. Insufficient water supply causes death and illness. Children turn to painting to depict the trauma caused by the massacres which they have witnessed.

The Annual Conference of the Humanitarian Aid held in Basel on 23 March 2012 addressed these issues under the motto “sharing responsibility” and explored how Switzerland can help to relieve people from such suffering.
