Mediation Perspectives: Meditation for Mediation?

Mediation Perspectives is a periodic blog entry provided by the CSS’ Mediation Support Team and occasional guest authors. Each entry is designed to highlight the utility of mediation approaches in dealing with violent political conflicts.

Did you know that the US Army trains its soldiers in meditation techniques in order to make them more resilient  to provocation when they go into battle? While this fact may not be relevant to most mediators, it highlights how meditation can be used in unexpected ways. The inspiration for me to explore the relationship between meditation and mediation a little further came when I read Dan Harris’ bestseller “10% Happier”, where he does indeed mention the use of meditation techniques by the US Army. Besides being an entertaining read, Harris’ book also does a great job of exploring the use of meditation techniques in modern-day ways. In the following blog, I hope to build on Harris’ example and 1) briefly distinguish between meditation and mediation as disciplines, and 2) then highlight five meditation principles that can make mediators more effective. The principles center on active listening, dealing with emotions, distinguishing between process and results, practicing self-care, and embracing the right “mediation attitude”.

The balance of power in Latin America is shifting. Large, recently thriving countries like Brazil are struggling, hampered by domestic scandals. The economies of oil-dependent countries like Venezuela and Ecuador are stagnant, while other nations, such as Chile and Mexico, seem poised for growth. Amid this turbulence, countries are striving to reposition themselves. World Policy Journal consulted a panel of experts to help understand what issues are defining their countries’ changing roles in the region.

The most pressing problem Latin America faces today is narcotrafficking. As Pope Francis mentioned in his U.N. speech in September, narcotrafficking is accompanied by human trafficking, money laundering, the arms trade, child exploitation, and other forms of corruption. This trade increases violence, with Latin America’s poorest people caught in the middle as the state tries to eliminate drug rings or stop rivalries between cartels.

Moreover, the narco state destroys economies. Illegal networks arise, concentrating on trafficking in substances, arms, and persons. But then they “diversify” into general smuggling and kidnapping. Narco-economies generate enclaves that displace other productive endeavors. Financial and human capital are chased away by the prospect of escalating violence.

Last year saw an almost total absence of reports of piracy and armed robbery at sea in the western Indian Ocean and off the coast of Somalia. This is the laudable outcome of concerted international and regional counter-piracy efforts.

Since 2012, there has been an annual decline in the total number of reported attempted and actual attacks in the region. The decline has led to calls for reforms to four key international counter-piracy institutions in the new ‘post-piracy’ environment.

These reforms are important, but will not provide lasting solutions if African maritime, economic and developmental interests are neglected.

It will therefore be vital that local stakeholders, such as the African Union (AU) and the Intergovernmental Authority on Development (IGAD), drive new developments.

The drop in piracy figures means that many counter-piracy institutions and mechanisms are now seen as costly, inconvenient, cumbersome and unjustified. In their present configuration, many of these measures also seem inadequate. New maritime security tasks entail more than simply keeping piracy suppressed, but are also about simultaneously building blue economies and conducting peacebuilding in Somalia.

On Monday, the World Health Organization (WHO) declared the Zika virus a public health emergency of international concern, with the potential to infect up to four million people in the Americas by year’s end. Under increasing pressure to slow the spread of the disease, the Brazilian government has stepped up its response, including mobilizing 220,000 military personnel to cities across the country.

According to Brazil’s ministry of health, the military will be used to spread awareness by going door-to-door, handling out pamphlets, and distributing mosquito repellent. However, it is believed that the troops will also use this opportunity to identify which homes are potential breeding grounds for mosquitoes and target those sites for surveillance and fumigation. Mosquitoes are known to carry the Zika virus, which has been linked with the rare congenital condition microcephaly in newborn babies.

The Fight against the ‘Islamic State’ in Syria and the Right to Self-Defence

Since the outbreak of the Syrian civil war in 2011, organised networks have spread out across borders, overtaking cities. The most famous of these is the ‘Islamic State of Iraq and the Levant’ (ISIL), more commonly known as ‘Islamic State’ (IS) (Flasch, 2015: 3). Militants of IS now control wide portions of territory in Iraq and Syria as well as an area in Libya. IS has killed and injured thousands of people and IS-related violence has led to the displacement of over a million people. Atrocities committed by the IS have extended to several other countries in the Middle-East, in West-Africa, and in Europe (Zerrouky, Audureau and Vaudano, 2015).

In response to attacks of IS, Iraq has requested that the United States and its allies assist it in defending itself against the group. Since September 2014, Iraq, together with the United States and several other states, has been using force against IS in Syria without the consent of the Syrian regime. Iraq acts on the basis of its right to individual self-defence and the other intervening states intervene on the basis of the right to collective self-defence. Self-defence, as well as the use of force within an authorisation given by the United Nations (UN) Security Council, constitute the two exceptions to the international prohibition on the use of force between states (Articles 51 and 42 UN Charter). An action in self-defence can be individual, when the victim state reacts to an armed attack, or collective, when other states react to an armed attack on the request of the victim state. France began its military intervention in Syria in September 2015, resorting to the rights to both individual and collective self-defence. After the terror attacks of IS in Paris on 13th November 2015, France extended its strikes, on the basis of the right to individual self-defence and asked for assistance. Several Western states, including the United Kingdom and Germany, decided to be involved in different ways in the fight against IS in Syria, invoking in particular the right to collective self-defence and, sometimes, also the right to individual self-defence. Russia too has been perpetrating strikes in Syria since November 2015 but these happen with the consent of that state. Consent by Syria to the resort to force by Russia precludes the wrongfulness of that act in relation to Russia and thus provides legal grounds for Russian military action (Article 20 of the Draft Articles on Responsibility of States for Internationally Wrongful Acts, 2001).
